General conditions

  • All information provided by participants to the Gadaku Institute/ Rots en Water NL, its staff or trainers, is kept confidential and remains strictly personal.
  • You have the right to cancel your order or registration up to 14 days after confirmation without giving a reason. If the first day of the training falls within that 14-day period, the maximum cooling-of period is only until the training begins.
  • A confirmation or receipt of the registration or order will be sent to the customer with the dates and payment terms.
  • The language in which contracts (and information) will be formatted is clear and unambiguous.
  • The contract will state the name and details of the Gadaku Institute/ Rots en Water NL, the name of the training, the duration of the contract, any materials, books, guidance and services which are included and which are not, the costs, payment terms such as the payment period and the method of payment. The conditions under which the training may not take place and the cancellation policy.
  • The copyright of all text and photos from books, brochures and from the website belongs to the Gadaku Institute / Rots en Water NL and may not be used and or copied without permission.
  • It is not permitted to use the knowledge gained during a Rock and Water training for the following commercial purposes.
    (1) Conducting Rock and Water training sessions themselves for a fee to professionals, including but not limited to teachers, mentors, educational experts, youth care and youth work staff and internal counselors, working in such sectors as (but not limited to) education, counseling, juvenile detention and mental health, among others.
    (2) Nor is it permitted to use the knowledge gained to enable third parties to conduct Rock and Water training themselves to persons working in (but not limited to) the above industries. This provision should be understood as a non-compete clause. Gadaku Institute trainings are conducted to enable participants to apply the knowledge gained during a training in practice – the field – and with children and/or adolescents.
    If this provision is violated, the participant shall be liable for an immediately payable fine of €25,000 for each violation. The foregoing applies unless expressly agreed otherwise in writing.
  • It is not permitted to use the name Rock and Water, RockWater and or similar names as a trademark, trade name, company name, domain name or in an email address unless otherwise expressly agreed upon in writing.
  • All participants who register are aware that participation in a Rock and Water training is voluntary and at their own risk. They are also aware that physical injuries may occur during the exercises as a result of participating in this training. The Gadaku Institute is not liable for direct or indirect damages, including (but not limited to) physical injury, loss of income or lost opportunities.
  • The Gadaku Institute may refuse training participants without giving any reason. Gadaku Institute may refuse participants in any case if there are well-founded suspicions that the participant in question is employed by a competitor of Gadaku Institute.
  • Cancellation policy: If cancelled up to 4 weeks before the start of the 3-day basic training course, €50 will be charged; for all other training courses, if cancelled up to 4 weeks before the start of the training course, €25 will be charged. For cancellations up to 2 weeks before the start, all trainings will be charged 50% of the total amount and after that the full amount will be charged. If a participant is unable to attend, he or she is entitled to be replaced without charge, provided that this has been notified in advance to the Gadaku Institute / Rots en Water NL. Any overpayment will be refunded within 14 days.
